OFFICIAL RULES
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING.
TWO WAYS TO ENTER: During the Sweepstakes Period, enter into a contract with Imperial Structured Settlements ("Sponsor") for the exchange of future structured settlement payments for a lump sum and you will receive one (1) entry into the Sweepstakes ("Contract Entry"). TO ENTER FOR FREE: Call 866-909-8643 between the hours of 8:30am-6:00pm EDT and provide the representative with your name, address, and telephone number ("Telephone Entry") (Telephone Entries and Contract Entries together, "Entries"). Automated entries will be disqualified. Entries that are inaudible or unintelligible will be disqualified. Sponsor assumes no responsibility for human or technical error in the transmission or receipt of Telephone Entries. All Entries must be received by Sponsor by 6:30pm EDT on September 30th, 2009. Limit one (1) Entry per person/household/address for the entire Sweepstakes Period, regardless of entry method. Entries become the property of Sponsor and will not be returned. The Sweepstakes is void where prohibited by law, and it is subject to all federal, state, and local laws and regulations.
TIME PERIOD: The Sweepstakes begins on August 14th, 2009 and ends September 30th, 2009 ("Sweepstakes Period").
ELIGIBILITY: The Sweepstakes is open to legal residents of the 50 United States and the District of Columbia, 18 years of age or older, who are located in the United States or the District of Columbia at the time of entry. Employees, contractors, directors and officers of Imperial Structured Settlements, its subsidiaries, distributors, sales representatives, and advertising, promotion and judging agencies and all other service agencies involved with the Sweepstakes, and members of the immediate family (spouse, parent, child, sibling and their respective spouse) and household of each such employee are not eligible to participate.
WINNER SELECTION/ODDS: One (1) winner will be randomly selected from among all eligible Entries in a random drawing to be conducted on or about September 30th, 2009 ("Potential Winner"), under the supervision of Sponsor, whose decisions are final and binding in all matters. The odds of winning depend on the number of eligible Entries received. Potential winners are subject to verification, including verification of age. If a Potential Winner is found not to be eligible or not in compliance with these Official Rules, or if prize notification or any prize is returned as undeliverable, the Potential Winner will be disqualified.
GRAND PRIZE: There will be one (1) Grand Prize winner ("Winner"). Sponsor will pay the Winner's mortgage or rent for the period beginning August 14th, 2009 and ending September 30, 2009, up to the maximum amount of two thousand six hundred dollars ($2,600.00). Winner may be required to submit to Sponsor Winner's mortgage or rent statements and other documentation for verification, in Sponsor's sole discretion. Grand Prize will be awarded in the form of a check made payable to Winner. No more than the maximum amount set forth herein or the amount state on the applicable statements, which ever amount is lesser, shall be awarded. Approximate retail value (“ARV”) is two thousand six hundred dollars ($2,600.00). The difference in value of prize as stated herein and value at time of prize notification, if any, will not be awarded. Prize is non-transferable and no cash equivalent or substitution of prize is offered, except at the sole discretion of the Sponsor. Limit one (1) prize per person/household/mailing address. Unclaimed prizes will not be awarded. All federal, state, and local taxes associated with the prize, are the sole responsibility of the winner.
WINNER NOTIFICATION AND VERIFICATION: Potential Winner will be notified by email, phone and/or express mail on our about September 30th , 2009. Sponsor is not responsible for any change of email address, mailing address and/or telephone number of entrants. Potential Winner may be required to complete, sign and return an Affidavit of Eligibility/Liability Release, and, where lawful, a Publicity Release, within 14 days of attempted notification or prize may be forfeited. Prize won by an eligible entrant who is a minor in his/her state of residence will be awarded to minor's parent or legal guardian who must sign and return all required documents.
RULES: The Sweepstakes will be governed by these Official Rules. By entering, all entrants agree to be bound by these Official Rules and the decisions of Sponsor and its agents, whose decisions are final on all matters relating to this sweepstakes.
LIMITATIONS OF LIABILITY: Sponsor, its subsidiaries, and affiliates, advertising/promotional agencies and the officers, directors, agents, and employees of all such companies (collectively, the “Released Parties”) are not responsible for and shall not be liable for: (i) lost, misdirected, illegible, unintelligible, damaged, incomplete, late, or postage due mail or entries; (ii) any act, failure to act, delay, or error relating to the transmitting or processing of entries, whether negligent, reckless, or willful; (iii) postal service, telecommunications network, phone system, or other difficulties of any kind; (iv) any conditions caused by events beyond the control of Sponsor that may cause the sweepstakes to be disrupted or corrupted; (v) any losses or damages of any kind resulting directly or indirectly from acceptance, use, or misuse of any prize awarded in the sweepstakes or from participation in the Sweepstakes; or (vi) any printing or typographical errors in any materials relating to the Sweepstakes. By entering the Sweepstakes, all entrants (or their parent of legal guardian if an eligible minor) agree (and agree to confirm in writing): (a) to release and hold harmless the Released Parties from and against all costs, expenses, damages, injuries, claims, causes of action, or losses of any kind arising out of or in connection with participation in the sweepstakes or acceptance, use, or misuse of any prize and any travel related thereto, including but not limited to claims for personal injury, death, property damage, defamation, infringement of intellectual property rights, and claims based on the rights of publicity and privacy; (b) under no circumstances will entrant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; (c) all causes of action arising out of or connected with this Sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action; and (d) any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, excluding attorneys’ fees and court costs.
DISRUPTION OF SWEEPSTAKES: Sponsor may prohibit any entrant from participating in this Sweepstakes or any future promotion, and may refuse to award a prize to an entrant, if Sponsor determines, in its sole discretion, that such entrant: (i) has tampered with the entry process or operation of the Sweepstakes; (ii) has violated these Official Rules; or (iii) has acted in an unsportsmanlike, improper, or otherwise disruptive manner, with an intent to annoy, abuse, threaten, or harass Sponsor or any other entrant. Sponsor reserves the right, in its sole discretion, to cancel, modify, terminate, or suspend this sweepstakes without notice in the event of terrorist activity, acts of war, or other events constituting a national, state, or local emergency, or if causes beyond Sponsor’s control corrupt the administration, security, or operation of the Sweepstakes. Sponsor is not responsible for incorrect or inaccurate entry information whether caused by telephone users or by any of the equipment or programming associated with or utilized in the Sweepstakes or by any technical or human error which may occur in the processing of the entries.
PUBLICITY: By entering the Sweepstakes, each entrant agrees to have his or her name, photograph, voice, biographical information, and likeness used in any and all media, by Sponsor and its designees, for advertising, publicity, and promotional purposes relating to the Sweepstakes and future similar sweepstakes, without further compensation or notice, except as prohibited by law.
GOVERNING LAW: By entering, entrants agree that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, participant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of State of Florida without giving effect to any choice of law or conflict of law rules.
